A construction project could end in tragedy for both the contractor and the owner/developer should an escalation in material costs occur following the execution of a fixed price contract. This article presents a summary of possible legal and contractual remedies in the event of excessive escalation in material costs for existing contracts and offers alternative protections for future contracts, through sample escalation clauses for new construction contracts.
