Florida Supreme Court Upholds Graves Amendment


The Florida Supreme Court recently held that the Federal Graves Amendment which shields car rental companies from vicarious liability claims by injured third parties preempts Florida Statute 324.021(9)(b)2. There is now officially no vicarious liability claims against negligent car rental companies.

This recent development erases an area of uncertainty in Florida law. The Florida Supreme Court decision was predictable. Car rental companies are now free to deny and delay claims with impunity.
