Woman who cannot Close Her Eyes Sues Doctor, New York Medical Malpractice Lawyer Comments


New York medical malpractice lawyer David Perecman examines the recent medical malpractice case of Marilyn Leisz. A cosmetic surgery left her unable to fully shut her eyes. Apparently, Leisz's surgeon removed too much skin, something which came as a shock to Leisz. She claimed she was led to believe the procedure was minor.

She sued the doctor for medical malpractice and a New Jersey jury awarded her $115,000, though she expected a lot more.

The jury found that the surgeon had deviated from the accepted standard of care. However, the jury did not agree with Leisz's other allegation that she was not fully advised of the risk of incomplete eye closure that comes with undergoing this type of cosmetic eye procedure. Leisz had had approximately 30 cosmetic surgery procedures done before this one.
