SUMMARY: Appellant, Bottom Line Equipment, had brought suit against Smith & Associates Consulting, LLC and Travelers Insurance related to the rental of certain construction equipment. The equipment owned by Bottom Line was stolen while in possession of Smith & Associates, and the equipment was insured by Travelers.

The district court had granted Traveler's summary judgment motion, wherein they argued that the equipment at controversy was not insured by the policy. Travelers argued that one piece of equipment was not listed by the insured within 30-days, and as to the other piece of equipment, Travelers argued that the policy was for actual cost and not replacement cost, thereby reducing its exposure.

Bottom Line appealed the ruling of the trial judge with the Louisiana 5th Circuit Court of Appeals, and submitted this appellant brief.
