Football Locker Room Hazing Incident

Every media outlet in the bay area got a hold of the story of a hazing incident in a football locker room at Alhambra High School. The allegations were that 6 freshman football players taped up a teammate as part of a "bullying" incident. The allegations also included follow up "cyber bullying". 6 players were suspended over the incident but only one, the so-called "ring leader" was served expulsion papers. The police sent a report of the incident to the District Attorney's Office. The family was referred to our firm by another attorney in the community based on our cross-over background in education law and juvenile criminal defense. The family retained our services. We contacted the school and sought to enter into discussions to informally resolve the matter but the school district officials refused to engage in informal discussions. We proceeded to make statutory demands regarding issuance of subpoenas; an open hearing and other demands. We also included references to the education code to support our requests including legal references as to why the expulsion was not warranted under the education code. We also began to contact witnesses and build a case for selective enforcement. When a lawyer gets involved on an education matter most school districts knee jerk reaction is to get their own attorney involved. They did so in this case. I had worked with the School District's attorney before. Shortly after my initial discussions with the School District's attorney the expulsion was dismissed.
