Ruling and Order Granting Preliminary Injunction


In this important Title IX gender equity decision, Judge Stefan Underhill of the U.S. District Court for the District of Connecticut granted a preliminary injunction preventing Quinnipiac University from eliminating its women's volleyball team. Judge Underhill found that the University's "roster management" practices - limiting the sizes of men's teams while requiring women's coaches to carry prescribed numbers of athletes on their squads - distorted the University's reporting of athletic participation opportunities for male and female athletes. The decision raises questions about the limitations of roster management techniques as tools for Title IX compliance by academic institutions.
