Abandono Afetivo: do foco do problema a uma terceira solução

A Constituição brasileira de 1988 trouxe uma nova hermenêutica normativa e influenciou principalmente o direito de família. Nesta seara, a concepção da paternidade tem sido gradativamente superada, deixando a perspectiva biológica para ser configurada nos âmbitos social e psicológico. Como consequência, os deveres parentais, hodiernamente, gozam de grande importância e o descumprimento deles, a que se atribui a denominação de abandono afetivo, tem suscitado, nos últimos anos, demandas nas quais se pleiteia indenização por danos morais – dentre elas, o primeiro precedente de um tribunal superior - Superior Tribunal de Justiça. Diante deste cenário, a doutrina civilista tem como seus maiores dilemas: seria o abandono afetivo capaz de gerar um dano indenizável? As regras do direito de família já são suficientes? A indenização é a única alternativa? A presente pesquisa tem por escopo sugerir respostas a estes questionamentos, buscando alternativas ao tratamento jurídico em casos de demandas judiciais por indenização decorrente de dano por abandono afetivo do pai.

The Brazilian Constitution of 1988 brought a new normative hermeneutics and influenced primarily the family law. In this perspective, the conception of fatherhood has been gradually overcome, leaving the biological perspective to be configured in the social and psychological areas. Consequently, the parental duties, currently, enjoy of great importance and the non-compliance of them, assigning the denomination of emotional abandonment, has been generated, in recent years, demands where plead compensation for moral damages (Superior Court of Justice - Brazil high court). In this scenario: would the emotional neglect capable of generating damage liable of indemnity? The rules of family law are enough? Is the indemnity the only alternative? This research suggests answer to these questions, searching alternatives to the legal treatment in cases of lawsuits for indemnity caused by father's emotional neglect.
