Order Allowing Claim for Treble Damages for plastic surgeon's promises in an email, before and after photos on website and comments about other doctors


This D.C. medical malpractice/consumer protection case involved allegations against a plastic surgeon of both medical malpractice and violation of the DC Consumer Protection Act which allows for triple damages. In this case, when the patient was deciding whether to hire a certain plastic surgeon, she received an email from the surgeon which she believed guaranteed her certain results and also she was convinced by the surgeon's "before and after" photos on his website that she would obtain a certain result if she hired him to perform her surgery. There was also an allegation that the physician dissuaded the patient from consulting and/or hiring other local physicians by speaking negatively about them. This Order from D.C. Superior Court is important to patients, doctors and the attorneys who represent them.
