Delay in Claim By Insurance Company - Insured's Passenger's Original Petition Against Insurance Carrier

When a driver is injured by another driver, he or she expects to be compensated with a settlement for the personal injuries by the liable driver’s insurance carrier. That is precisely what occurred in this case.

But what happens when the driver’s own insurance carrier unreasonably delays or fails to compensate him or her? If you must make a claim against your own uninsured / underinsured motorist coverage through your automobile insurance policy, don’t expect it to take proper care of you. It will still operate like any insurance company does, to save as much money as possible, by denying or delaying claims as long as possible.

There are certain statutes in Texas that govern how an insurance company must process and pay claims for its customers. You will need the help of a professional and experienced personal injury trial lawyer to pursue a case under those statutes when your own insurance company is trying to take advantage of you.
