Memorandum of Decision


This decision held that my clients Tony & Marie Guerriero could file a chapter 7 bankruptcy even though their income was higher than usually allowed (above median). The Court held that they could deduct the expense of a mortgage on a home they intended to surrender on the "means test."

This was an important victory for all above median Massachusetts filers, and is often cited.
