With the development of enhanced technologies for the extraction of gas, namely horizontal drilling and hydrofracing, drilling in the Marcellus Shale in Pennsylvania has resulted in some of the most productive wells in the eastern United States. This development has led to increased leasing throughout the areas under which the shale lies. A problem arises when partial owners of the gas rights cannot be located. This can be addressed by an action filed pursuant to the Dormant Oil & Gas Act. This memorandum sets forth the basics of prosecuting an action under the DOGA.
