Medaglia Decision


This group of documents gives the background motions, responses, and Judge Votolato of the Bankruptcy Court of Rhode Island's decision regarding foreclosures and subsequent bankruptcy filings. Ultimately, the Judge determined that whether or not the deed was filed following foreclosure was not dispositive; once the foreclosure sale occurred, a subsequent bankruptcy filing would not negate the sale based upon failure of the buyer to file the deed. This was a reversal of previous case law and had a profound effect on several cases that I was working on at the time.
