Georgia is an "attorney" closing state. This can make transactions involving parties who are not physically present at the closing technically difficult for the closing attorney. In addition, even though Georgia attorneys generally represent the lender at closing, the Court has now enunciated a "duty to the public" as a justification for restricting the closing of real estate transactions to attorneys. This article deals with one facet of this conundrum.
