Mining company's physical taking claim goes to trial


Northern Idaho silver, zinc, and lead mine (Placer Mining Co., Inc.) has filed a takings lawsuit arising out of the federal government's actions under Superfund, that have make it impossible for the mining company to engage in large-scale mining of its property: "Although there is no legal impediment to further mining, Placer Mining claims that the concrete channel and bridge constitute a practical, physical barrier preventing large-scale mining development of the property." The trial judge has denied both parties' motions for summary judgment, which means that the parties are going to trial.
