Writing Sample - Fair Housing Act Violation - Motion for Summary Judgment


This motion for summary judgment was prepared for my Legal Method and Writing class in the Spring of 2009. I was assigned to represent the plaintiff, a college for blind students that wished to establish a home for students visiting the defendant Town of Pleasantville. Research was restricted to reported cases in the Third Circuit Court of Appeals, with citations to other circuits for persuasive value only, and statutory authority was limited to the federal Fair Housing Act.

For brevity, I have excerpted the body of the motion and deleted the cover page identifying the parties and the signature page that would have been submitted in the final draft.

The assignment culminated in an oral argument before a panel of practicing attorneys.
