Respondent City of Methuen's Memorandum of Fact and Law


This is respondent's Memorandum of Fact & Law filed with the Commonwealth of Massachusetts' Commission Against Discrimation regarding a police officer's claim of employment discrimination against the City of Methuen. The respondent requests that the Commission make a determination of lack of probable cause.

This Memorandum addresses the issues of employment discrimination, disability discrimination, national origin/race discrimination, pretext, insufficient evidence to support a finding of probable cause, the burden of proof, the three prong test enunciated in Wheelock College vs. MCAD, the four element test set forth in Lipchitz vs Raytheon Company, res judicata, collateral estoppel, claim preclusion, issue preclusion, and the exceptions to issue preclusion.
