Win-Win SCC CGL Construction Decision


This decision represents a victory for the Plaintiff, and the defnece lawyers who must now consider coverage issues in a whole new light.

Speaking for the Supreme Court of Canada, Justice Rothstein read the policy wording, rather than applying legal constructs. The case represents a Made-in-Canada approach for cgl poliicies and goes so far as to suggest that in this kind of construction case, the cgl policy picks up where a Perfomance Bond leaves off.

It is a logical extension to the reasoning in Bridgewood Building Corp. (Riverfield) v. Lombard General Insurance Co. of

Canada (2006), 266 D.L.R. (4th) 182.
