Petition against unlicensed therapist of autistic children.


Suit filed against a behavioral analyst providing therapy for a child diagnosed with autism spectrum disorder, when she violated stated ethics policies by having an affair with Plaintiff's wife. Named defendants included the clinic in which she worked, the Department of Elementary and Secondary Education, and the Behavioral Analyst Certification Board. Claims include negligence, negligent hiring, vicarious liability, violation of the merchandising practices act, and loss of consortium. The therapist was not licensed by any state organization, but had certification through a national organization. The national certifying organization ethics policy but did not investigate ethics complaints.
