Regulation 64 and Your Property Damage Claim

New York State provides rules and regulations which prohibit insurance carriers from unfair claims settlement practices.  Regulation 64 sets forth guidelines and timelines for the proper handling of your claim.

Some essentials provided by Regulation 64 include: 

  • An insurance carrier cannot compel a policy holder or claimant to use a particular repair facility.
  • If an insurance company wishes to inspect the damages to your vehicle it must be completed within six (6) business days from notification of the accident.
  • An insurance company has 5 business days to issue a settlement check after an agreement is reached or they have received a release.
