True Expungement


Over the years I have heard many disseminate false information about expungement in Arizona. There is true expungement in Arizona under limited circumstances. And for those that don’t fit into those limited circumstances, there are other options such as filing a motion to set aside the conviction.

The circumstances which must be met for true expungement to be possible are: (1) The crime must have been committed while the person was under 18 years of age, (2) the person was convicted of a felony, (3) the person was not sentenced to prison, (4) the person does not have a historical prior felony conviction, (5) the person successfully completes probation. If all of the above are true, the person may file a motion to expunge the record.

Expungement includes the conviction being set aside, release from all penalties and disabilities resulting from the conviction and the clerk is ordered to notify each agency to which the conviction was reported that the conviction has been expunged.

If you or someone you know meets the above criteria, it’s time to put the criminal record behind you by having the record expunged.
