State v. D.M.

Amended Memorandum of Law in Support of Motion to Dismiss

Memorandum of Law in Support of Motion to Dismiss based on Florida's "Stand Your Ground" law, i.e., self-defense immunity from prosecution. While ultimately this case pled out to a reduced charge and a period of probation, it was a good result because client was a prison releasee reoffender and was looking at a mandatory 15 year sentence if convicted. While I like to think the Motion would have succeeded, the client would have risked a lot if he didn't take the deal.
