Motion To Change Style

The style of a case is the heading found at the top of all pleadings. It starts with the case number at the top. On the right hand side it lists the court that the action is to proceed in by stating what type of court it is, what number it is and what county it is from.On the left hand side it states the official designation of the case.

In this motion the case was a probate. The deceased used her middle name throughout her life and when filling out the forms at my office my client used the deceased’s middle name as her first name. Not knowing any better we styled the case with the middle name first.

Unfortunately the style of the case must match the name that will go on the official documents that will go to the bank and those documents must match the records of the bank. This meant that we had to change the style of the case to show the deceased’s full legal name.

At the time the Williamson County probate court had never run into this problem so I drafted this motion. The probate court has since adopted this motion as it’s standard form for changing the style of a case and has used it several times since.
