Petition for Writ of Garnishment


This draft petition for writ of garnishment can be used to collect judgments by essentially suing the bank that holds the judgment debtor’s funds. Generally the bank freezes the accounts that have been identified in the writ and files a response with the court asking for a hearing to determine what should be done with the funds. Often the judgment debtor will contact the filing attorney and after the initial storm of outrage passes may negotiate to have the writ released for a payment in settlement of the judgment.
