Closing Argument

Boone v. Goldberg, transcript of closing argument by plaintiff’s counsel, Patrick Malone, in a medical malpractice trial in Montgomery County, Maryland Circuit Court in Rockville, Md. The case concerned a brain injury that occurred in ear surgery. Here is a series of images from a CT scan that prove the surgeon punctured the patient’s brain during the surgery.

The case ultimately made significant new law in Maryland, with the Maryland Court of Appeals holding that patients had a right under the informed consent doctrine to find out the amount of experience their surgeon has in doing the proposed surgery.
