Memo on illegal expenditure of public funds and other issues


This case is a challenge by a village Mayor, in her individual and official capacity, as well as derivatively, on behalf of the village, to an attempt by a village board majority to expend public funds to engage private counsel to investigate the Mayor on unspecified and unidentified allegations, after alleged secret meetings. The challenge is based on (a) the lack of authority of a village to conduct an investigation of an elected public official, (b) withholding by the majority of the basis for investigation from two of five board members and on violation of New York's Open Meetings Law. The memorandum of law discuss the legal issues involved from the plaintiff-petitioner's viewpoint.
