Brief in Support of Motion for Partial Summary Judgment


This case involved a large family trust that had been wrongfully depleted by the defendant. The defendant was not a beneficiary of the trust. He was a step-brother of the plaintiffs. He used his elderly mother to withdraw the substantial trust funds and turn their control over to him. He then systematically moved the funds across state lines to conceal his possession of them. The case involved litigation over a substantial trust inheritance. It also involved specific aspects of Alabama trust law. The plaintiffs were successful in obtaining a favorable ruling from the Court and the return of their remaining trust funds.
