The often neglected section of a lease addressing subordination, attornment and non-disturbance has finally come into focus for many tenants, landlords and lenders. The struggling real estate market and the tenuous financial stability of many landlords has made it imperative for lenders and tenants, in particular, to focus on the SNDA to protect and define their respective rights and obligations. This article describes the SNDA, explains it's importance and addresses provisions which are critical to the respective parties to the SNDA.
