Copyright Law & Piracy in Nigeria


The presentation for a public lecture for students of Information Resources Management at Babcock University, Ilishan-Remo, Ogun State, Nigeria.

It is an overview of the law regarding copyright,its infringements, reliefs and remedy under the Nigerian municipal law.

The presentation begins with a conceptual analysis of the general law or concept of property and its ramification into realty and personalty, and the latter into chattel real and chattel personal, and the latter into tangibles and intangibles and the latter into other rmifications of which intellectual property forms a part.

We then condsider various typologies of Intellectual property:

The typology based on the nature of the work/interest to be protected (creative/academic works), trade, business or economic interests, and invention.

The typology based on whether the interest in registrable or otherwise.

The typology based on the source of law governing its protection - statute or common law.

We then examined an overview of the legal framework for protection of intellectual property in Nigeria, including statutes and common law.

We progressed by now focussing on the law governing copytight in Nigeria including Copyright Act, Cap C28 Laws of the Federation of Nigeria, 2004.

Nonetheless, in considering remedies and reliefs, we also considered remedies under the common law as well.
