Non-union arbitration award

The private employer is a retail store that has an arbitration procedure for non-union employees who are discharged. An employee was discharged for taking a product without paying for it. The employee claims she should not have been discharged because other employees had taken such products without paying for them and they were not discharged. The employer disagreed and indicated that employees who were caught stealing products were always terminated. The arbitrator agreed with the employer and determined that the employer had just cause to terminate the employee and that the termination was appropriate discipline for the theft.
