Delgado v. Trax Bar & Grill

Letter Brief to the Justices of the California Supreme Court on the Negligent Undertaking Doctrine


Michael Woolery Delgado sued Trax Bar & Grill in 1996 for injuries he sustained when he was assaulted by a group of patrons in the bar's parking lot. Delgado succeeded in obtaining a jury verdict, which was appealed. On appeal to the 5th District Court of Appeal (California State), the Court vacated the jury award in favor of Delgado. Delgado petitioned the California Supreme Court for review, which was granted. In 2005, the California Supreme Court overruled the Court of Appeal's decision, which can be found at 30 Cal.Rptr.3d 145 (2005).
