Federal Circuit Opinion on Grey Market Imports


First opinion issued by the Federal Circuit on the importation of Grey Market goods in violation of U.S. Trademark. This was a case before the United States International Trade Commission. I was co-counsel with my father before the Commission and lead counsel on the appeal before the Federal Circuit. One issue of first impression was decided as to used goods being capable of trademark infringement when imported into the United States. I have since represented importers in federal court in other litigation.
