Same Sex Marriage Law Update- Summer, 2010

The summer of 2010 provided two major decisions regarding same sex marriage. The First Circuit Court agreed with arguments of Massachusetts Attorney General, Martha Coakley and GLAD (Gay and Lesbian Advocates and Defenders) by opining that the Federal Defense of Marriage Act(DOMA) was unconstitutional in Massachusetts because it discriminates against same sex couples. A California Court overturned Proposition 8, which banned same sex marriage, because it violated the due process clause and the equal protection clause of the U.S. Constitution.
