This article, which was originally published in the Defense Research Institute's In-House Quarterly, Fall 2010 edition, discusses the challenges of an insurance carrier's raising insurance issues at the mediation of a civil lawsuit against the carrier's policyholder -- specifically, when the carrier is providing its policyholder with a legal defense under a reservation of the right to dispute liability coverage for any judgment or settlement. The article discusses the challenges, as well as specific steps that an insurance carrier, or its counsel, can take to raise insurance issues without disrupting the mediation process.
