SUMMARY: Wolfe Law Group's client, Box Opportunities, Inc., was sued by Argence, L.L.C. on an open-account. After Argence, LLC received a default judgment against Box Opportunities, Box filed a Motion for New Trial. The motion was denied as untimely.
Box Opportunities appealed the denial arguing that the motion was timely because a Notice of Judgment had not been properly mailed to the defendant.
This is the order of the appeals court for the 4th circuit, reversing the order of the trial court, allowing the new trial, and ordering that the new trial be granted.
