Texas Homeowners are increasingly learning that banks and lending institutions who appear to be in talks with owners in default of their mortgage contracts are still moving forward with foreclosure proceedings. Owners of homes who are seeking loan modifications, waivers, or extensions in the terms of their mortgage must get all documents in writing, and must record all conversations. When an agreement is reached, homeowners should send a letter to the bank or lending institution outlining the terms of their agreement. Homeowners should also ask for terms agreed to in writing. It would also be prudent to be cautious and to hire a foreclosure defense attorney to protect yourself in case the bank is moving forward with the foreclosure sale at the same time they are negotiating your mortgage loan modification.
