City of Arnold v. Tourkakis

Brief of Amicus Curiae Show-Me Institute

This amicus brief was filed in support of Dr. Homer Tourkakis, a dentist whose practice had been condemned by the City of Arnold so it could be handed over to a private developer for the construction of a shopping center. The brief explains the history of property rights under the Missouri Constitution, particularly focusing on how the 1945 Constitutional Convention enabled the expanded abuse of eminent domain authority by conflating that governmental power with the exercise of the police power. The brief also points out the sheer scale of abuse in the state of Missouri, particularly among smaller municipalities such as Arnold, and calls on the Missouri Supreme Court to restore constitutional protections to the state's property owners.
