BVDA Requested Findings of Fact and Conclusions of Law


This Requested FOF and Conclusions of Law was filed in a case dealing with the state discharge permit for the Homestake Uranium Mill supe-rfund site in Milan, New Mexico. Some issues of importance were whether: (1) there was a need for the construction of an additional evaporation pond, (2) discharges of uranium and other toxic materials were contaminating the aquifer, (3) radon emissions from the site were above state and NRC permitted levels, (4) the new pond should be permitted in the 100-year floodplain, and (5) whether final disposal at the site should be in the new, double-lined, leak-detection pond or in an old, single-lined, no-leak-detection pond.
