Petition for Post Conviction Relief - Ineffective Assistance of Counsel; Donald Issue (rejection of plea offer)


This is a Petition for Post-Conviction Relief, under Arizona's Rule 32 of the Rules of Criminal Procedure. The defendant had been offered a plea of 5 years and faced 17-63.75 if convicted of all charges. He rejected the plea, went to trial and was sentenced to 21.5 years. There were a number of issues dealing with ineffective assistance of trial counsel. The winning issue had to do with the trial attorney's inadequate explanation of the plea. The conviction was overturned.
