This is a case where I represented a young woman who was pulled over by San Diego's top DUI cop for allegedly running a stop sign. This cop was kicked off the DUI enforcement team back in 1992 for falsifying police reports. Some 15 years later, he is put back on the DUI enforcement unit, and starts fabricating traffic violations to support him stopping and searching cars and passengers. The trial court - a former police officer and former police office union lawyer - declined my request to get into the officer's personnel jacket. I filed the appeal with the Fourth District Court of Appeal in San Diego and won. This, howver, is an unpublishd opinion. I asked the Court of Appeal to publich it because it dealt heavily with Brady discovery, but the request was declined. I later sued this officer in federal court after he falsely stopped another motorist. We settled the case immediately. He is still patroling the streets, making up false reasons for stops.
