Ordinances establishing schemes for transferable development rights (TDRs) must take account of the legal issues arising when drawing boundaries of the sending and receiving zones for transferable rights. Setting these boundaries implicates unique issues as well as traditional zoning issues.

This paper lists and describes these issues, makes suggestions for TDR ordinances, and considers TDR zones under Georgia law.
