Johnny Richardson v. Steelcase

Appeal Brief

Johnny Richardson suffered a severe work-related injury at Steelcase in Athens, Alabama. Although severely limited because of his injury, he returned to work and settled his workers' compensation claims for a small amount. After struggling to continue working for several years, he eventually left his employment because of his injuries. Mr. Richardson then hired our firm and we petitioned the trial court to re-open his workers' compensation claim. We successfully litigated his claim and received an award for full benefits based upon a permanent and total disability at trial. Steelcase then appealed the trial court decision. We were again successful on appeal. The subsequent decision by Alabama's appellate courts was the first published decision allowing a worker to re-open a previously settled claim and receive benefits for a total disability after attempting to return to work. Our primary appellate brief is attached.
