Motion for Summary Final Order in administrative proceeding for determination of non-compensability under the Florida Birth-Related Neurological Injury Compensation Act (NICA) based on the fact that there was no participating physician present at the birth of the baby. If NICA applies, it is the exclusive remedy. If NICA does not apply, a medical malpractice lawsuit may be prosecuted.
