The passage of Senate Bill 3 in 2005 ushered in significant changes to the tort system in Georgia. Notably, the amendments to O.C.G.A. Sections 51-12-31 and 51-12-33 created a new scheme of apportionment of fault and abolished joint and several liability
among co-defendants. They also established a new concept of apportioning fault to nonparties.
