In re: Valley Academy Charter School

Order granting Amended Petition

Under Pennsylvania law, a group seeking to form a Charter School must meet a number of criteria in order to appeal a local school district's denial of a charter application. In this case, the local school district denied the charter application. To be able to appeal that decision to the Pennsylvania State Charter School Appeals Board, I represented the charter school in hearings in the Court of Common Pleas. We successfully established, over the school district's numerous objections, that the school's supporters diligently and correctly obtained over 1,000 legitimate signatures supporting the school's appeal. We established that the correct affidavits were signed and submitted. After presenting witness testimony and legal arguments and briefs, the Court of Common Pleas entered this Order granting our petition. Now, we can obtain review on the merits of the application before the Pennsylvanis State Charter School Appeals Board.
