The relationship between intellectual property rights and competition law - European Union trends


The clash between intellectual property rights and competition policy rules is subject to scrutiny by law enforcers, legal practitioners and academics on both theoretical and practical levels. Such relationship was often denounced to failure, as it was regarded to be hard to ‘marry the innovation bride with the competition groom’ . Academics in the area of both, law of intellectual property and competition law, have developed many theories on how these fields of our legal system influence one another, how they complement and whether it is possible for them to co-function effectively side by side.
