Damian Furtch was brutally beaten outside a McDonald's in New York's West Village and left with two black eyes and multiple stitches. The NYPD and New York civil rights lawyer David Perecman are investigating the incident as a hate crime. Police classified it as a hate crime because anti gay slurs were yelled during the attack. However, in a twist to what looks like a New York hate crime, the man who admitted to the brutal assault insists it wasn't a hate crime because he's gay too.

Being charged with a hate crime in New York is a factor that can enhance the severity of the consequences for conviction on other charges such as assault.
