Memo of Law Opposing NYC Summary Judgment Motion pertaining to the Sidewalk Law


My client was injured when he tripped and fell on a defective curb condition in Kings County New York. The City moved for summary judgment arguing that they were not responsible for my client's injuries under the Sidewalk Law. However, the curb is specifically excluded from this particular law and is considered part of the street. To the best of my knowledge the cases cited in this brief have not been overturned on Appeal in the Appellate Division and the Supreme Court cases cited were not taken up on Appeal.
