The Constitution affords everyone the freedom of association. For many of us, this right is taken for granted and only when this right has been infringed upon do we realize its' absence. In California, the Street Terrorism Enforcement and Prevention Act can enhance a defendants sentence based not only on the their actions but the actions of those classified as part of the defendants' street gang. This article paints a picture that can show how, unwittingly, a defendant can find themselves guilty by association. The Patriot Act can easily be analogized to the STEP Act and the erosion of Constitutional rights all in the name of fear of terror.
