Appellate Decision


The Washington Court of Appeals reversed the grant of a temporary restraining order issued by the Superior Court for the State of Washington in and for Clark County from use of the term CUSTOM RV INTERIORS in marketing and websites. The Court of Appeals determined that the lower court erred in ruling that the term was protectable. The Court of Appeals agreed with Rylander & Associates PC's argument on behalf of its client that the term was generic for the business of providing custom rv interiors, and thus unprotectable and unenforceable.
