This is an Attorney's Affirmation (including Memorandum of Law) pertaining to plaintiff's motion for summary judgment pursuant to Section 240(1) of the New York State Labor Law covering construction site accidents. Plaintiff's motion for summary judgment was granted by the trial court and the matter settled at mediation prior to trial.
